Please take time to read through our conditions of sale, we like to treat our customers as we would like to be treated ourselves, however, the law states we need to set terms and conditions of sale. Your statutory rights are not affected.

My Gemstones are referred to “We”, “Our” and “Us” and a user of this website is referred to as “You” or “Your”

General

All pages of on our website are subject to our terms and conditions outlined below.

If any part(s) of these terms and conditions are legally unacceptable or unenforceable by English law that shall not prevent the remaining conditions from being effective and enforceable. These terms and conditions are governed by English law.

You use our site on the condition you are over the age of 18 years.

We reserve the right to change product prices and content of our website at anytime without notice.

All weights and sizes are approximate unless stated otherwise in the product description and photographs are not actual size.

All products are legally hallmarked were required by a UK Assay Office to guarantee the precious jewellery metal is of the fineness stated.

Our jewellery is not suitable for the initial piecing or healing process.

Ordering From Us

We only accept orders from the United Kingdom.

All products are offered subject to availability. If for any reason we are unable to supply the product you will be notified as soon as possible.

You will be sent an order acknowledgement email confirming and detailing the product(s) which you have ordered.

We reserve the right to refuse to accept any particular order at our sole discretion.

Payment

Payment can be made by any specified credit/debit card which is stated in the Payment Options Page or PayPal. We only accept cards registered within the United Kingdom.

Your card details are encrypted and processed securely by our payment service provider; Sagepay and our merchant bank Streamline.

We will take payment from your card/account upon receiving your order before we ship the product(s) to ensure there are sufficient funds on the card and we are in cleared funds.

The product price you pay is in Pounds Sterling and the price advertised on our website. This price includes delivery within the United Kingdom.

It is a crime to use fraudulent details and credit or debit cards which have been stolen or credit or debit cards not registered in the buyers own name. Should anyone be caught using our website with the intent to obtain property by deception, we will prosecute to the fullest extent of the law.

We are pro-active in helping to fight online fraud, from time to time we may contact you by email or telephone if it’s your first order from us to confirm you are the registered card holder.     

Delivery

Delivery of our products is to customers within the United Kingdom only.

If you pay by PayPal we regret we can only deliver to your confirmed or registered address with PayPal. We are afraid this is out of our control and apologise should this cause any inconvenience.

Delivery charges are included in the product price.

We will make every effort to deliver products with the estimated timescale of five to seven days. However from time to time due to low stock levels or delays from the manufacturer products may take longer. Should this be the case you will always be notified as soon as possible after receiving your order.

All orders will require a signature upon delivery. Once the order has been signed for they shall be at the risk of the buyer.

Should a product be incorrect or damaged inside the presentation case we are to be notified within 48 hours after delivery by email.

Returns / Guarantee

We provide a 21 day money back guarantee with all orders on the condition the goods are unworn with any tags still attached, in there original condition and returned with the gift packaging for a prompt refund.

Due to Health reasons earrings can only be returned when the sealed bag has not been opened. Unless the earrings are being returned faulty. This does not affect your statuary rights.

Personalised jewellery is excluded from our guarantee unless faulty. Jewellery which has been altered in size or length is also excluded.

When returning any goods, please email us first so we know to expect your goods for return. For your own benefit we also recommend using Royal Mail Special Delivery as then your goods are insured whilst in transit. We do not refund the return postage costs.     

Your Right to Cancel

Under the Distance Selling Regulations, you have the right to cancel your order/contract with us by informing us in writing within seven days beginning on the day you take delivery of the products. However we offer a 21 day guarantee for extra peace of mind.

Limitation of Liability 

We are providing this website on an ‘as is’ basis and make no warranty of any kind, expressed or implied with respect to the website or content, information or products included in this website or that the website and emails be free of infection or virus, it is your responsibility to take precautions for this. We reserve the right to change our products and prices without notice. Should we discover an error with a product price, we will be under no obligation to fulfill the order. We shall not be liable to you for any website which links to or from us.

We shall not be liable to you for any consequential loss, loss of data, loss of income or damage to property.

If we become liable to you, then this will be limited to the amount paid for the product(s) concerned.

Nothing in these terms and conditions limit our liability for death or personal injury that arises as a result of negligence.

Warranties

We will pass on any warranty provided by the manufacture.

Complaints

We take complaints seriously and go to a great deal of effort to ensure you don’t need to, however, should you need to make a complaint please email us. We will respond to your compliant within 48 hours and will aim to resolve any complaint within 14 days.

We comply with the standards of the Data Protection Act 1998.

To ensure you details are protected we use 128 bit secure payment pages which are provided by SagePay, one of the leading payment service providers. Our merchant bank is Streamline.

When a purchase is made we only require your personal information to be able to fulfill your order. We will only contact you by telephone if it’s in relation to the order which you have placed with us. These details are; your name, the delivery address, e-mail address, telephone number and payment method details. Yours details will be held on our secure system with SagePay.

We do offer a marketing email service which anyone may join. You will receive a maximum of 12 emails per year. You can un-subscribe at any time by emailing us. 

We will not pass on or sell your information to a third party company for marketing purposes.

We use cookies on our website to be able to keep tack of your shopping session and the contents you place in your shopping cart. Cookies also help us provide you with a better website and shopping experience. We are able to monitor which pages of our site are viewed the most and which products are the most popular. A cookie gives us no information about you as a person and does not provide us access to you computer. 

You are able to choose to accept or decline cookies; you can do this by modifying your browser settings. Please note this may restrict what you can and cannot access online. Cookies need to be active to use the full functions of our website. 

Our website may from time to time have links for other websites that may be of interest to our visitors.
